1. Introduction

Eagle 3D Streaming ("we," "us," "our," or "Eagle 3D") is committed to protecting your privacy and securing your data. This Privacy Policy details our practices regarding the collection, use, disclosure, storage, and protection of personal information when you interact with our platform, including our website at eagle3dstreaming.com, the Eagle 3D Dashboard (Control Panel), pixel streaming services, APIs, and related tools and services (collectively, the "Services").

This policy applies to all users of our Services globally, including both Self-Serve plan users and Enterprise plan clients. It is important to understand that while Eagle 3D Streaming implements robust security measures for all users, full compliance with the European Union's General Data Protection Regulation (GDPR) is provided exclusively to clients under customized Enterprise plans through a separate Data Processing Addendum (DPA). Self-Serve plans operate under a different data governance framework.

2. Key Roles: Data Controller and Data Processor

In accordance with data protection laws like the GDPR, it is essential to define the roles and responsibilities concerning personal data. Eagle 3D Streaming operates under a dual-role model depending on the context of the data:

• Eagle 3D Streaming as a Data Controller: We act as the Data Controller for the personal information we collect directly from you to establish and manage your customer relationship with us. This includes information used for account creation, billing, customer support, marketing communications, and platform administration. As the Controller for this data, we determine the purposes and means of its processing.
• Eagle 3D Streaming as a Data Processor: We act as the Data Processor for any content, applications, and end-user data that you (or your organization) upload, stream, or otherwise process through our platform. This includes Unreal Engine application files, project data, session logs, and any personal data belonging to your end-users or contained within your applications. In this context, you (or your organization) are the Data Controller. We process this data strictly according to your instructions as embodied in your use of the Service, our Terms of Service, and, for Enterprise clients, a signed DPA.

3. Information We Collect

We collect information necessary to provide, secure, and improve our Services. This falls into several categories:

3.1. Information You Provide Directly (Account & Billing Data)
• Identity and Contact Data: Full name, business email address, phone number, company name, and job title.
• Account Credentials: Username and hashed password.
• Billing and Payment Data: Billing address, payment method details (processed securely by our third-party payment processors; we do not store full credit card numbers).
• Communications: Contents of your inquiries, support tickets, feedback, and survey responses.
3.2. Information Collected Automatically (Technical & Usage Data)
• Device and Connection Information: IP address, browser type and version, operating system, device identifiers, and network information.
• Usage Data: Logs of your interactions with the Eagle 3D Dashboard, including pages visited, features used, time stamps, and clickstream data.
• Cookies and Similar Technologies: As detailed in Section 9.
3.3. Information Related to Your Use of Streaming Services (Operational Data)
• Application and Project Data: Unreal Engine applications (.7z packages), project files, configuration settings, and environment variables you upload. You have full control to delete these applications at any time via the Dashboard.
• Streaming Session Data: Metadata about streaming sessions, including session IDs, start/end times, duration, geographic region of streamer VMs and users, bandwidth usage, and performance metrics (e.g., frames per second, latency).
• Infrastructure Data: Information about the cloud resources provisioned on your behalf, such as virtual machine identifiers, GPU types, cloud provider, and region.
• Diagnostic and Crash Data: Log files generated by the Unreal Engine during streaming sessions, including application crash reports and error messages, which may be collected to assist with troubleshooting.
• Streaming Analytics Data: For streaming analytics and performance optimization, we may collect approximate geographic location data (e.g., country or region level) derived from IP addresses or network routing information. This data is not precise GPS location and is approximately 70% accurate for identifying general geographic areas. Unlike many websites that request precise location access, Eagle 3D does not request or trigger browser location permission prompts (e.g., "Allow this site to access your location?"). If precise location data is required by a specific Unreal Engine application you are streaming, your browser may prompt you for permission independently; that data is controlled solely by the application and not accessed by Eagle 3D.

3.4. Information from Third Parties

We may receive information about you from:

• Business Partners: Such as cloud service providers (AWS, Google Cloud, Azure) as part of joint service delivery.
• Publicly Available Sources: To verify business information or for sales prospecting, in compliance with applicable laws.

4. How We Use Your Information (Purposes and Legal Bases)

We use the information we collect for the following lawful business purposes. The processing is based on the legal grounds outlined in the General Data Protection Regulation (GDPR), specifically Article 6.

5. How We Share Your Information

We do not sell your personal data. We share information only as described below:

• With Your Consent: We will share information with third parties when you direct us to do so.
• With Trusted Service Providers (Sub-Processors): We engage specialized companies to perform functions on our behalf. These providers are contractually bound to protect your data and use it only for the services we have engaged them for. Key categories include:
○ Cloud Infrastructure & Hosting: Amazon Web Services (AWS), Google Cloud Platform (GCP), Microsoft Azure, CoreWeave.
○ Payment Processing: Stripe, Inc.
○ Communications & TURN Services: Twilio, Inc.
○ Analytics & Monitoring: Google Analytics (with anonymization features enabled).
○ Customer Support & Operations: Jira (by Atlassian).
○ Corporate Infrastructure: Microsoft Office 365, Slack Technologies.
• For Legal and Safety Reasons: We may disclose information if we believe it is necessary to:
○ Comply with a valid legal process (subpoena, court order, government investigation).
○ Protect the rights, property, or safety of Eagle 3D Streaming, our users, or the public.
○ Enforce our Terms of Service or other agreements.
• During a Business Transfer: In connection with a merger, sale of company assets, financing, or acquisition, user information may be transferred as a business asset. We will notify you via email and/or a prominent notice on our website of any change in ownership or uses of your information.
• Authentication & Login Data Storage: User login credentials and authentication session data are managed using Firebase Authentication, a service provided by Google. Firebase applies industry-standard security controls.

Eagle 3D Streaming does not control or determine the specific geographic location where Firebase stores authentication data. This infrastructure is managed by Google in accordance with its own security and data processing standards.

If a user signs in using a Google account, account-level authentication data is handled by Google. Eagle 3D Streaming does not have the ability to delete or modify data stored directly within a user's Google account. Users must manage or delete their Google account data directly through Google.

Data Processing Agreements (Art. 28 GDPR): We have concluded data processing agreements (DPAs) with all sub-processors that process EU personal data. These are contracts mandated by data privacy laws that guarantee they process personal data only based on our instructions and in compliance with the GDPR.

6. International Data Transfers (Chapter V GDPR)

Eagle 3D Streaming is a cloud-agnostic platform. To provide global, low-latency streaming, your data may be stored and processed in data centers located in various countries, including the United States and within the European Economic Area (EEA).

When personal data originating from the EEA, UK, or Switzerland is transferred to countries not deemed to provide an adequate level of data protection (Art. 45 GDPR), we implement appropriate safeguards as required by Art. 46 GDPR. These safeguards typically include:

• Standard Contractual Clauses (SCCs): We ensure that our agreements with sub-processors incorporate the European Commission's approved SCCs where applicable.
• Data Privacy Framework: Where available, we utilize U.S.-based service providers who participate in and certify their compliance with the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

7. Data Retention and Deletion (Art. 5(1)(e) GDPR)

We retain personal data only as long as necessary to fulfill the purposes outlined in this policy (principle of storage limitation), or as required to comply with our legal obligations, resolve disputes, and enforce our agreements.

Your Control Over Data: You have direct control to manage and delete certain personal data through the Eagle 3D Dashboard (Control Panel):
• From Your Dashboard, You Can Delete:
○ Unreal Engine applications and project files
○ Project configuration settings and environment variables
○ Streaming session logs and analytics data
○ Account profile information (name, contact details, preferences)
○ Authentication and session data
• Requires Contacting Support:
○ Complete deletion of your Eagle 3D account
○ Billing and payment history data
○ Historical support ticket communications
○ Legal and compliance records

To request the deletion of your entire account or billing-related data, please contact our support team at support@eagle3dstreaming.com.

Unless a more specific retention period has been agreed upon in a separate contract or is required by applicable law, your personal data will be retained until the purpose for which it was collected no longer applies. If you assert a valid request for deletion (Art. 17 GDPR) or revoke your consent to data processing, your data will be deleted, unless we have other legally permissible reasons for storing it (e.g., tax, commercial law retention periods, or the need to preserve evidence in legal disputes). In such cases, deletion will occur after these reasons cease to apply.

We follow secure deletion practices in accordance with our internal data handling policies. Data may persist in encrypted backup systems for a limited period as part of our disaster recovery strategy before being permanently overwritten.

If a user authenticates using Google Sign-In, deleting an Eagle 3D account does not delete the user's Google account or related authentication records stored by Google. Those must be managed directly with Google.

8. Your Data Protection Rights (Chapter III GDPR)

Depending on your location and the laws that apply to you (such as the GDPR for EEA residents (Arts. 12-23) or the CCPA/CPRA for California residents), you may have certain rights regarding your personal data.

For data where we act as a Processor (e.g., your project data), you should use the tools within the Eagle 3D Dashboard to manage that data directly.

Right to Lodge a Complaint (Art. 77 GDPR): You have the right to lodge a complaint with a supervisory authority, in particular in the EU member state of your habitual residence, place of work, or place of the alleged infringement.

9. Cookies and Tracking Technologies

9.1. What Are Cookies?

Cookies are small data files placed on your device. We use them and similar technologies (e.g., web beacons, pixels) for the essential functioning, security, and analysis of our Services.

Cookies on our platform are used strictly for essential functionality, security, and performance optimization. Eagle 3D does not create marketing or profiling cookies.

If essential cookies are not accepted, certain core platform features (including login and streaming session management) may not function properly. In some cases, the platform may not operate at all without strictly necessary cookies.

Under GDPR and applicable EU cookie laws (ePrivacy Directive / TTDSG), strictly necessary cookies may be used without prior consent where required for service functionality. However, where consent is required, we obtain it through our cookie interface.

For users located in the European Union, performance-enhancing features that rely on analytics cookies are only activated after consent. If consent is not provided, certain optimization features (such as automatic performance or quality adjustments) may be limited.

For users located outside the EU, cookies may be used to improve streaming performance and quality where permitted by applicable local regulations.

9.3. Managing Your Cookie Preferences

You can manage your cookie settings through your browser controls. Please note that blocking essential cookies will prevent parts of our Services from working correctly. For opt-out mechanisms related to third-party analytics (e.g., Google Analytics), please refer to the respective provider's website.

10. Our Security Commitment (Art. 32 GDPR)

Protecting your data is our top priority. We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, including:

○ Endpoint protection using Application Gateway (AGW) and reverse proxy infrastructure

• Multi-Factor Authentication (MFA): MFA is enforced for internal administrative access to infrastructure systems where data is stored or processed (e.g., AWS environments, analytics systems, and internal operational tools).

While we implement industry-standard measures, no method of electronic transmission or storage is 100% secure.

11. Legal Compliance

We design our Services to comply with applicable data protection laws.

• For Enterprise Clients: We offer customized, contractually-bound compliance with specific regulations like the GDPR through a Data Processing Addendum (DPA) that incorporates the Standard Contractual Clauses and details our joint obligations.
• For California Residents: We adhere to the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), respecting the rights outlined in Section 8. We do not "sell" or "share" personal information as defined under the CCPA/CPRA.
Important Note: Our Self-Serve plans implement strong security and privacy practices. However, certain regulatory, data localization, or contractual requirements (such as strict GDPR storage or processing guarantees) may require architectural adjustments. These adjustments can impact system performance and infrastructure costs. In such cases, organizations requiring customized compliance commitments, enhanced data governance controls, or specific storage configurations should contact us to discuss an Enterprise plan with a tailored Data Processing Addendum (DPA).

12. Children's Privacy

Our Services are designed for businesses, professionals, and developers. They are not intended for use by individuals under the age of 16. We do not knowingly collect personal information from anyone under 16. If you are a parent/guardian and believe your child has provided us with personal information, please contact us immediately so we can delete it.

13. Third-Party Links

Our website or Dashboard may contain links to third-party websites or services. This Privacy Policy does not apply to those third parties. We encourage you to review their privacy policies.

14. Changes to This Privacy Policy

We may update this Privacy Policy periodically. The "Last Updated" date at the top will indicate revisions. We will notify you of material changes via email or a notice in your Dashboard.
